Effective date: 19/October/2026
1. About these terms
These Terms & Conditions govern use of Barakat Al Shams and orders placed directly through the website with Barkat Al Shams, operated by BARKAT AL SHAMS RESTAURANT L.L.C, trade licence number 1090908, at Shop D33, Wasl District, after Hyatt Place Hotel, Fish Roundabout, Al Maktoum Hospital Road, Deira, Dubai, United Arab Emirates, United Arab Emirates.
By placing an order, you agree to these terms. Our Privacy Policy separately explains how we handle personal information. Orders placed through an external marketplace are also subject to that platform's applicable terms and order procedures.
2. Customer responsibilities
You must have the legal capacity to place an order or act with the permission and supervision of a parent or legal guardian. Provide accurate contact, delivery and payment information and use only payment methods you are authorised to use.
If accounts are available, keep your login details secure and tell us promptly if you suspect unauthorised access. Do not misuse the website, interfere with its security, submit fraudulent orders or abuse our staff or delivery personnel.
3. Menu and availability
Menu items are subject to availability and serving hours. Images are illustrative; appearance and presentation may vary. We aim to describe products accurately, but ingredients and preparation may vary. Contact us before ordering if an ingredient or dietary requirement is essential to your decision.
We will not substitute a materially different item without your agreement. If an ordered item is unavailable, we will contact you about an alternative or refund the unavailable item. If we cannot fulfil the order, we will cancel it and refund amounts paid for the cancelled order.
4. Allergies and dietary requirements
Please contact us before ordering if you have a food allergy, intolerance or specific dietary requirement. An order note alone does not confirm that we can safely meet your request.
Our kitchen may handle common allergens and cross-contact may occur. We cannot guarantee an allergen-free item unless we expressly confirm that we can provide it. If we cannot safely accommodate your requirement, we will tell you. Nothing in this section excludes our food safety duties or your legal rights.
5. Prices and payments
Prices are displayed in UAE dirhams (AED). Applicable taxes, delivery fees, service charges, minimum order requirements and discounts will be disclosed before you confirm payment. The checkout total is the amount payable for your order.
Available payment methods are shown at checkout. Cash on delivery is available only when offered. An invoice or receipt will be provided as required by law.
If a pricing or technical error affects an order, we will explain it and ask whether you wish to proceed at the corrected price. We will not charge an increased amount without your agreement. If you decline or we cannot fulfil the order, we will cancel it and refund the payment received.
6. Order acceptance
Submitting an order is a request to purchase. An automated acknowledgement or payment authorisation alone does not mean the restaurant has accepted it. Your order is accepted when we send confirmation that it has been accepted for preparation.
We may reject an order for a reasonable reason, including unavailable items, an address outside our delivery area, payment failure or suspected fraud. If payment was collected for a rejected order, we will refund it. Temporary authorisations may take time to be released by your bank.
7. Delivery and collection
Delivery is available within the areas and hours shown on the website. Estimated arrival times depend on preparation, traffic, weather and operational conditions. We will make reasonable efforts to meet the estimate and inform you of significant delays. Your rights in relation to non-delivery or unreasonable delay remain unaffected.
Provide a complete address, a reachable telephone number and any access instructions. Be available to receive the order. We will make reasonable attempts to contact you if delivery cannot be completed.
If an incorrect address, lack of access or inability to contact you prevents delivery, we will explain the available options. Any proposed redelivery charge will be disclosed and agreed before redelivery. A refund may be reduced only to the extent lawful and justified by the circumstances; no blanket forfeiture applies.
Leaving an order unattended requires your agreement. For collection orders, attend the selected branch within the confirmed collection period. Food should be consumed or stored promptly in accordance with any instructions provided.
8. Changes and cancellations
Contact us immediately to request a change or cancellation. We can usually accommodate requests before preparation begins. Once preparation has started, changes or cancellations may not be possible because food is made to order and is perishable. We will explain any lawful charge before confirming a requested cancellation.
If we cancel an order or cannot supply it, we will refund the amount paid for the unfulfilled order, including related delivery and service charges where applicable. These rules do not restrict your rights when food or delivery is faulty, unsafe, incorrect or not supplied as agreed.
9. Order problems and refunds
If your order is missing, incorrect, damaged, unsafe or otherwise unsatisfactory, contact +971 52 869 5048 as soon as reasonably possible. Include the order number and a description of the problem. Photographs may help us investigate, but a lack of photographs does not automatically invalidate a complaint.
Do not consume food you reasonably believe is unsafe. We will investigate and provide the remedy required by law and appropriate to the issue, which may include a replacement, partial refund or full refund. A discount or account credit will not replace a refund you are legally entitled to unless you agree.
Prepared food generally cannot be returned for resale. This does not remove your rights where an order is defective or not supplied as agreed.
Approved refunds will be issued to the original payment method where possible. For cash orders, we will agree an appropriate refund method with you. The time for funds to appear depends on the payment provider and your bank. We will tell you if a different method or additional processing time is necessary.
10. Promotions
Promotional offers are subject to the conditions displayed with the offer, including validity dates, minimum spend, eligible items and usage limits. Offers cannot be combined unless stated. We may decline fraudulent or clearly abusive use, but changes to an offer will not retrospectively remove a valid discount from an accepted order.
11. Website content and availability
Website text, logos, photographs and designs belong to us or our licensors. You may use the website for personal browsing and ordering. Commercial reproduction or misuse requires the rights holder's permission.
We take reasonable steps to keep the website available and accurate, but maintenance and interruptions may occur. Contact customer service if a technical issue affects payment or an order.
12. Responsibility and events outside our control
We remain responsible for the obligations that applicable law places on us, including food safety and fulfilment of accepted orders. Using a delivery or payment partner does not remove obligations that we legally owe you.
We are not responsible for losses caused solely by your misuse of the website or materially incorrect information you provide, to the extent permitted by law. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, or removes mandatory consumer rights.
Events outside our reasonable control may delay or prevent fulfilment. We will notify you where practicable and explain available options. If we cannot fulfil your order, we will refund amounts paid for the unfulfilled order as required by law.
13. Complaints and governing law
Please contact us first so we can try to resolve a complaint. This does not prevent you from contacting the competent consumer protection authority or exercising your legal rights.
These terms are governed by the applicable laws of the United Arab Emirates. Disputes may be brought before the competent courts of Dubai, subject to mandatory jurisdiction rules and consumer rights.
14. Changes to these terms
We may update these terms and publish a revised effective date. The version in effect when your order was accepted applies to that order. Material changes affecting ongoing account services will be communicated where required by law.
